Sylvia Ann Driskell, a 66-year-old woman from Auburn, Nebraska, submitted a petition to the U.S. District Court of Omaha, to force a judge to rule whether being gay is a sin.
The lawsuit, called Driskell vs. Homosexuals, was submitted in one seven-page handwritten document on Tuesday.
Proclaiming herself as “God’s ambassador,” Driskell is not a lawyer–she references no legal precedent and no relevant court cases. In fact, she bases her case primarily on Bible passages and dictionary definitions (she prefers Webster’s.) Both of which will have little bearing in a court of law.
Driskell takes particular umbrage not just with the prospect of gay marriage, but what she sees as a state-sanctioned support of gay actions.
“I’m sixty-six years old and never thought that I would see the day in which our great nation or our great state of Nebraska would become so compliant to the complicity of some people’s lewd behavior,” she wrote in her lawsuit.
“The way to destroy a nation or state is to destroy its morals – look what happen to Sodom and Gomorrah two city because of the same immoral behavior that’s present in our nation, in our states and in our cities.”
Despite Driskell’s lawsuit, the U.S. District Court does not likely have jurisdiction to rule something as a “sin.” And, even if they did, it’s unlikely it would matter–“sins” like adultery are perfectly legal in the United States of America.
In the meantime, I would not encourage gay Americans to reach for their checkbooks just yet: apparently, no official summons has been issued to move this case forward.
